Terms of Service

By accessing or using Emploi's services and website, you agree to be bound by these Terms of Service and our Privacy Policy and Use of Cookies.

Definitions

  • "Emploi" or "Service Provider" means Emploi.world owned and administered by Worldwide Employment Solutions Oy (business ID 3300894-9) having its domicile in Helsinki, Finland.
  • "Candidate" means a person who creates a job seeker profile on the Service.
  • "Recruiter" means the person, firm, or corporate body (including recruitment agencies, staffing firms, and their subsidiaries or associates) and their authorized natural persons who use the Service to find, screen, or attract Candidates.
  • "Engagement" means the granting of access by a Candidate to a Recruiter to the Candidate's full non-anonymized profile and contact details, against payment of the applicable fee.
  • "Generally Private" refers to the personally identifiable sections of a Candidate's profile that are disclosed to a Recruiter only after a successful Engagement.
  • "Generally Public" refers to the anonymized sections of a Candidate's profile that are visible to any visitor of the Service.
  • "Service User" refers to any Candidate, Recruiter, or other user or visitor of the Service.

1. Eligibility and registration

The Service may only be used by persons who are at least fifteen (15) years of age. By registering, the Service User represents and warrants that they are at least 15 years old. Service Users aged 15 to 17 may register and use the Service only with the consent of a parent or legal guardian. Upon registration of a minor, both the minor and the parent or guardian are deemed to have accepted these Terms on the minor's behalf and to assume responsibility for the minor's use of the Service. The Service Provider reserves the right to terminate accounts where the required parental or guardian consent cannot be verified.

Service Users must also meet the minimum working age requirements of their country of residence.

The Service User is responsible for all activities carried out through their account and must promptly notify the Service Provider of any unauthorized use.

By registering as a Recruiter, the Service User represents that they are acting for purposes related to their trade, business, or profession.

2. Fees and payment

Basic registration is provided at no cost. Specific actions, such as an Engagement, or access to premium features may be subject to fees. The Service Provider offers the following payment methods for Recruiters:

  • (a) Tokens. Recruiters may purchase tokens to unlock individual Candidate profiles. Each Engagement consumes one token. If a Candidate declines a connection request, the token is refunded. Tokens are non-transferable and have no cash value. Unless otherwise stated at the time of purchase, unused tokens do not expire. The Service Provider reserves the right to change token pricing; price changes do not affect tokens already purchased.
  • (b) Subscriptions. Recruiters may subscribe to a periodic plan that includes a specified number of Engagements or access to premium features. Subscriptions automatically renew unless cancelled before the renewal date. Unused Engagements or features do not carry over unless expressly stated. The Service Provider will notify the Recruiter of pricing changes at least thirty (30) days before the new price takes effect.

General payment terms. All fees are exclusive of applicable taxes (including VAT), which will be added where required by law. Unless otherwise agreed, payments are due at the time of purchase (for tokens) or at the start of each billing period (for subscriptions). The Service Provider may use third-party payment processors. The Service Provider reserves the right to suspend access in the event of overdue payments. Refunds are provided only where expressly stated in these Terms or required by applicable law.

3. User obligations and acceptable use

The Service User bears responsibility for the accuracy of all information they provide and agrees to comply with applicable laws. The Service may only be used for lawful recruitment purposes. Service Users shall not:

  • (a) post false, misleading, or fraudulent information;
  • (b) engage in discriminatory practices;
  • (c) harass or send abusive messages to other Service Users;
  • (d) scrape, crawl, or use automated means to access the Service or extract data;
  • (e) create multiple accounts or fake profiles;
  • (f) share login credentials;
  • (g) attempt to circumvent security features; or
  • (h) use Candidate data for purposes unrelated to recruitment.

The Candidate is solely responsible for ensuring that no personally identifiable data appears in the Generally Public sections of their profile. The Service Provider may employ automated processes to identify personal identifiers but does not guarantee their effectiveness.

Violation of these obligations may result in immediate suspension or termination of the Service User's account without refund.

4. Liability of the Service Provider

The Service Provider strives to provide the Service without errors or interruptions but cannot guarantee uninterrupted availability. The Service Provider is not responsible for vulnerabilities in third-party software, services, or APIs.

The Service Provider is not a party to any agreement or relationship between Candidates and Recruiters. Disputes between Service Users are to be resolved directly between them. The Service Provider does not guarantee the truthfulness or accuracy of information provided by Service Users.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE PROVIDER'S AGGREGATE TOTAL LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OF SERVICE AND/OR THE USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (i) EUR 10,000 OR (ii) THE TOTAL FEES PAID BY THE SERVICE USER IN THE PAST TWELVE (12) MONTHS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE PROVIDER SHALL NOT BE LIABLE FOR LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF ANTICIPATED SAVINGS, LOSS OF BUSINESS OPPORTUNITIES, LOSS OF USE, LOSS OF DATA, LOSS OF CONTRACTS, LOSS OF REPUTATION, COST OF SUBSTITUTE SERVICES, OR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OR LOSSES. THE SERVICE USER BEARS ALL RISKS FOR THE INFORMATION USED BY OR OBTAINED FROM THE SERVICE.

The limitations above shall not apply to liability arising from willful misconduct, gross negligence, or death or personal injury, or to the extent that liability cannot be excluded or limited under applicable law.

5. Personal data and privacy

The Service Provider processes personal data in accordance with its Privacy Policy. By registering, Service Users become part of the Service Provider's user register. The Recruiter's first name is visible to the Candidate when the Recruiter initiates a connection request. The Recruiter's full identity and contact details are shared with the Candidate upon a successful connection. Recruiters are prohibited from using Service Users' personal data for purposes unrelated to the Service.

6. User content license

By submitting content to the Service, the Service User grants the Service Provider a non-exclusive, worldwide, royalty-free, sublicensable license to use, store, display, reproduce, and transmit such content for the purposes of providing, maintaining, developing, and promoting the Service. This license terminates upon deletion of the content or the Service User's account, except to the extent that the content has been lawfully shared with other Service Users or third parties prior to deletion in accordance with these Terms and the Privacy Policy.

User-generated reviews and ratings

Service Users may submit reviews or ratings of other Service Users through the Service. Reviews must be truthful, based on genuine interactions, and must not contain defamatory, discriminatory, or abusive content. The Service Provider reserves the right to moderate, edit, or remove any review at its sole discretion, including reviews that violate these Terms or applicable law. The Service Provider is not responsible for the content of reviews submitted by Service Users.

The Candidate has the right to control which reviews are displayed on their profile. Reviews are shown with the Candidate's permission, and Recruiters acknowledge that the reviews visible on a Candidate's profile may not represent all reviews received.

Audio and video content

Service Users may upload audio or video content (such as video introductions or skill demonstrations) to their profile. The Service Provider will apply anonymization measures (such as face blurring and voice modulation) to audio and video content displayed in the Generally Public sections of a Candidate Profile. The Candidate's original unmodified audio and video content will only be made available to a Recruiter upon a successful Engagement. While these measures reduce the risk of identification, the Candidate acknowledges that the content of their spoken statements (such as references to specific employers, locations, or experiences) may still allow identification. The Candidate is responsible for the content of their audio and video submissions and should avoid including highly identifying details in content intended for the Generally Public sections of their profile. The Service Provider reserves the right to moderate, restrict, or remove audio and video content that violates these Terms.

7. Intellectual property

The copyright, trademark, and other proprietary rights pertaining to the Service vest in the Service Provider and its partners. No part of the Service, including its software, design, content, algorithms, and data compilations, may be reproduced, modified, distributed, or used for commercial purposes without the Service Provider's prior written consent.

8. Changes to the Service and termination

The Service Provider reserves the right to modify, suspend, or discontinue any aspect of the Service, and to change the Terms of Service or pricing, at its discretion. Substantial changes will be communicated via the Service or the Service User's registered email. Continued use after changes become effective constitutes acceptance. Service Users who do not accept changes may terminate by deleting their account. The Service Provider may deactivate or delete inactive accounts.

9. Compliance with laws

Service Users shall comply with all applicable laws, including employment and labor laws, and the principles of the UN Universal Declaration of Human Rights and the ILO Declaration on Fundamental Principles and Rights at Work.

10. Prohibited countries

The Recruiter represents and warrants that neither the recruiting person, firm, nor corporate body resides in, nor will they recruit Candidates to: North Korea, Russia, Afghanistan, Belarus, Sudan, Syria, Myanmar, or Cuba.

11. Assignment

The Service Provider may assign its rights and obligations under these Terms, including associated User data, to a third party in compliance with applicable data protection law. Service Users may not assign their rights without the Service Provider's prior written consent.

12. Force majeure

The Service Provider shall not be liable for any failure or delay caused by circumstances beyond its reasonable control, including natural disasters, cyberattacks, infrastructure outages, governmental actions, pandemics, or failures of third-party service providers.

13. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14. Governing law and dispute resolution

These Terms of Service shall be governed by and construed in accordance with the laws of Finland, excluding its conflict-of-laws provisions and the United Nations Convention on Contracts for the International Sale of Goods (CISG). Any dispute arising out of or in connection with these Terms between the Service Provider and a Recruiter, where the amount in dispute exceeds EUR 10,000, shall be finally settled by arbitration in accordance with the Arbitration Rules of the Finland Chamber of Commerce. The seat of arbitration shall be Helsinki, Finland, and the language of the arbitration shall be Finnish where both parties are domiciled in Finland, and English in all other cases. All other disputes shall be submitted to the exclusive jurisdiction of the courts of Finland.
